Terms and Conditions

This Terms and Conditions is an agreement between you (.USER.) and Rushnetwork LLC ("RUSH"), which governs your use of the usenet and other services/products provided by RUSH to you, as well as all RUSH web sites related thereto.  You agree to read this Policy carefully and agree to all of the terms contained, or referenced, herein before using the Service.  By using the Service, you accept and acknowledge your agreement to the terms and conditions of the Policy set forth below.

Service

RUSH is providing the USER with the ability to search Usenet newsgroups using RUSH provided index data, select and download Usenet content using the RUSH provided client program from a third party Usenet Provider.  The USER is also permitted to use  their own newsreader client program to review, download and upload from the third party Usenet Provider.

Content

RUSH servers contain data which is indexed from Usenet servers using an automated process, without any human intervention. , We are not responsible nor do we control or influence content posted on the Usenet servers. Our automated indexing scripts do not screen or edit the information they collected nor could they be modified to do so. RUSH therefore cannot guarantee the search results will not contain objectionable, illegal or copyrighted martial.  Be aware that RUSH only directly offers access to indexed data, and no Usenet files are distributed through, file shared or are stored on our systems.

RUSH also provides the USER with a client program which allows the USER to search through Usenet newsgroup indexed data and download thru the third party Usenet provider.  This client program is provided AS-IS and its use or operation is not warranted or guaranteed.  The USER agrees to operate this program in a manner consistent with the terms and conditions outlined here.

RUSH provides access to Usenet data thru a third party arraignment with a Usenet provider allowing the USER to review message headers, upload and download Usenet articles using their RUSH account and the USER.s own newsreader client program.  No data flows thru, nor is stored on any RUSH server under this condition and the USER agrees to operate their own newsreader client program in a manner consistent with terms and conditions outlined here.

The USER  is responsible for determining the legal status of any material you use or duplicate from Usenet newsgroups. Some material that is available through Usenet newsgroups may be copyrighted and may have been distributed in violation of copyright laws. The USER agrees not to upload, download, post, publish, transmit, reproduce or distribute any files without permission of the copyright holder. You agree to use your account for lawful purposes only. Violations of this policy brought to our attention will be grounds for suspension of posting privileges or account termination.

If you are unsure of the copyright status, you should do what is right and ethical.

Transfer of others. personal confidential information or hacking to obtain it is a serious offense and will be treated as grounds for account termination. Violations may also lead to criminal prosecution or civil action taken against offenders.

Valid E-mail Address

The USER agrees to keep Rush informed of your current e-mail address. Your e-mail address is the primary way we contact you regarding support and service to your account.

You may update your e-mail account information on your account webpage.

Age Requirement

The USER certifies they are at least 18 years of age (or 21 years of age where required).

USER acknowledges they have read and agree with the Rush Privacy Policy and  its contents.

Indemnify and Hold Harmless 
The USER agrees to be responsible for all activities that occur in connection to their account. As a condition of service, you agree to indemnify and hold harmless Rush, its officers, employees, agents, and shareholders, for any action or cause of action resulting from the use of your account or the use of any services provided by Rush.   Rush is not responsible for any long distance charges or internet access charges a customer may accrue while using our service.

Availability of Service/Termination of Service

Rush will endeavor to provide a quality service to our customers. Our system is provided on an As Is and As Available basis without warrantees or guarantees. We make no guarantees as to system availability, though we will make our best effort provide the service our customers expect.  Rush reserves the right to restrict, suspend or terminate service or refuse service at its sole discretion to anyone at any time for any reason.  Rush also reserves the right to add, drop or modify any our products at any time. Rush takes reasonable care in publishing information about our service. Rush does not guarantee the accuracy or completeness of information posted on our web site or in advertisements. Typographical errors or technical inaccuracies are possible; if you see an error, please bring it to our attention by contacting our webmaster.

Intended Use 
Rush accounts are single-user accounts. This means that only one ip address is allowed to connect at a time, and the owner of the account (or their immediate family) is the only person(s) allowed to use that account. User Accounts are for personal, non-commercial use only. Users are prohibited from using a personal account to feed or operate a news server that provides access to a public network or that provides access to individuals other than the owner of the account. Personal accounts are not dedicated connection accounts and are prohibited from using them as such by maintaining a continuous connection for extended periods. Creation of multiple accounts will require payment in full for each account created. The USER will not attempt to bypass any security and/or access features of this service.

Billing and Settlement

Continuing Service Billing 
RUSH service is billed in advance in 30 day increments from the date you open your account or if your account is upgraded. Accounts are automatically renewed at the end of each 30 day service period for another service period. The rebill transaction may occur up to 24 hours before the end of the service period to ensure uninterrupted service.

Invoices and charges for your account can be viewed using the online account manager.

You can upgrade or downgrade your account at any time through the online account manager. Upgrades will be effective as soon as the transaction processes successfully with your payment method. Upgrading your account restarts your paid service for 30 days from the day you upgrade and changes your renewal date. Downgrades will be effective at the next billing service period. We do not prorate service. You can stop your service, or switch your service via the online account manager.

Payments 
We accept payments via credit card. We will attempt to charge your credit card or checking account for any balance on your account. If the first charge attempt for a service period fails, service will be suspended. We may attempt to recharge your credit card for up to 7 days. Service will be resumed when your card is successfully charged or you repurchase a new subscription via the online account manager.

Account Cancellation

How to cancel your account 
Service can be cancelled from the online account manager only. Otherwise, all accounts are renewed automatically. We do not accept account cancellations by email. Any account cancellation received by email will be ignored.

Customers paying by Credit Card 
Cancellations must be entered prior to the next service period for them to take effect before that billing period. Your service, and thus your billing, is in whole month increments.

Charge Backs / Charge Reversals 
By accepting these Terms and Conditions you agree that you will not initialize any chargeback with your credit card issuer for any charges authorized by your acceptance of these Terms of Service. It is hereby understood and agreed upon that an additional chargeback fee of $35.00 will be assessed to your account, if you initialize a 'chargeback' with your credit card issuer to reverse payment without our written permission for any of the charges authorized by your acceptance of these Terms of Service, and you hereby agree to pay this fee if this occurs. If you have any issues or disputes regarding our billing of your credit card you must first make contact with us by email to billing@rushnetwork.net, Your failure to do so may forfiet certain rights with your credit card issuer.

Refunds 
No refunds will be given under any circumstances except erroneous charges, including prepaid accounts or accounts deleted for violation of our Terms and Conditions

Rush reserves the right to revise, supplement or rescind any policy at any time without notice.
